1. Introduction

These Terms and Conditions ("Terms") govern your use of PriceFox (the "Service") operated by PriceFox ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

  • "Service" refers to the PriceFox application, website, and features.
  • "User," "you," and "your" refer to the individual or entity using our Service.

  • "Subscription" refers to the recurring payment arrangement for accessing premium features of the Service.

  • Maintain and promptly update your account information
  • Maintain the security of your account, including keeping your password confidential

We use Clerk for authentication services, and your account credentials are managed through their secure platform.

4. Subscription and Payments

Some features of our Service require a subscription. By subscribing to our Service:

  • You agree to pay all fees and charges associated with your subscription
  • You authorize us to charge your chosen payment method for these fees
  • All payments are non-refundable except where required by law
  • We reserve the right to change our pricing with reasonable notice

When using our Service, you agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Violate or infringe other people's intellectual property, privacy, or other rights
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Transmit any harmful code, such as viruses, malware, or other destructive elements
  • Create multiple accounts for abusive or fraudulent purposes
  • Scrape, crawl, or use automated methods to access our Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by PriceFox and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

While using our Service, you may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have our written permission.

7. User Content

Our Service may allow you to post, link, store, share, or otherwise make available certain information, text, graphics, or other material. You retain any rights you may have in this content.

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute it in any media. This license ends when you delete your content or account.

You are responsible for content you post and the consequences of sharing it.

8. Third-Party Services

Our Service uses third-party services including Clerk for authentication and Cloudflare for infrastructure and security. Your use of the Service also binds you to the terms of service of these third parties where applicable.

We are not responsible for the content, privacy policies, or practices of any third-party services. We encourage you to read their terms and conditions and privacy policies.

9. Service Availability and Modifications

We strive to ensure our Service is available at all times, but we do not guarantee uninterrupted access. We reserve the right to:

  • Modify or discontinue, temporarily or permanently, the Service with or without notice
  • Limit certain features or restrict access to parts or all of the Service
  • Update the Service with improvements, new features, or to address security concerns

We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

In no event shall PriceFox, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use or alteration of your transmissions or content

This limitation applies whether based on warranty, contract, tort, negligence, product liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date.
